Legal Update : Employers liability insurance for Landlords
The rules regarding Employer’s Liability insurance have recently changed and these modifications may now have an impact upon landlords employing staff or contractors.
Employer’s liability insurance has historically been a standard inclusion with many landlord’s insurance policies. However since the new Employers Liability Tracing Office (ELT) Regulations have come in force, this cover can only be included in your policy upon the production of certain information to the insurers.
If as a landlord you employ any staff (even temporary employees) you may be legally required to carry separate Employers Liability Insurance. Insurers will need your Employer Reference Number (ERN) which you will have been allocated if you collect pay-as-you earn tax (PAYE). Landlords will still be covered by existing policies, if their monthly payroll is less than £500.
Landlords who engage private cleaners and decorators rather than subcontracting to firms should check with their insurers whether they are or are not covered.
